Terms of Use

1. Agreement

1.1 Who we are. These Terms of Use (the “Terms”) are a contract between you and Elite College Fantasy Football LLC, doing business as ECFFB (“ECFFB,” “we,” “us,” or “our”), 1680 Campbell Ln., Suite 109 #1088, Bowling Green, KY 42104. They apply to your use of https://www.elitecollegefantasyfootball.com/ (the “Website”), the ECFFB app (the “APP”), and the features we offer through them, including the Mini-Challenges tab (together, the “Services”).

1.2 Acceptance. By creating an account or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

1.3 Official Rules control the Promotion. The ECFFB College Football Faceoff Bracket Challenge Contest (the “Promotion”) is governed by its Official Rules. If these Terms conflict with the Official Rules on anything about the Promotion, including eligibility, scoring, prizes, winner selection, notices, and Brand Partners, the Official Rules control.

2. Eligibility and Accounts

2.1 Age. You must be at least 18 years old to create an account. Entering the Promotion and winning prizes requires meeting the additional eligibility rules in the Official Rules, including the age of majority and residency rules. Some Brand Partner content is limited to users 21 or older, as described in Section 7.

2.2 One account per person. You may have one account. You must give accurate information, including your date of birth, keep it up to date, and keep your password confidential. You are responsible for activity under your account. Tell us promptly if you think someone else has used it.

2.3 Your affiliations. When you register (or, if you already have an account, the first time the APP asks), you may choose one college or university from the list in the APP and one military or emergency services cohort. These choices are optional. Once you make them, or once that step is complete without a choice, they cannot be added or changed. You confirm that your choices are truthful. We may ask for proof before paying a prize. Falsely claiming an affiliation can lead to disqualification under the Official Rules.

3. Using the Services

3.1 Acceptable use. You agree not to:

1. create more than one account, or use another person’s account;
2. use bots, scripts, scrapers, or other automated tools to enter, vote, or collect data;
3. submit false, duplicate, or manipulated entries or votes, or help others do so;
4. interfere with, overload, probe, or attempt to break the security of the Services;
5. reverse engineer or copy any part of the Services, except where the law allows;
6. use the Services to harass others, post unlawful or offensive usernames, or impersonate any person or organization;
7. use the Services in a way that violates any law or the rights of others;
8. resell or commercially exploit the Services or their data without our written permission; or
9. click, view, or interact with advertisements or Brand Partner content through automated means, in bulk, or for any purpose other than genuine interest, or otherwise generate false advertising activity.

3.2 Usernames and selections. Your username, rankings, scores, and bracket status may be visible to other users. Choose a username that does not reveal sensitive information. We may require you to change a username that violates these Terms.

3.3 Mini-Challenges. The College Football Bracket Battle and the American Service Champions Challenge are part of the Promotion and are governed by the Official Rules. The Ultimate Bracket Challenge Fan Vote is entertainment only, offers five options (ESPN, DraftKings, NCAA.com, Yahoo Sports, and ECFFB), awards no prize, is not a scientific poll, and closes as stated in the Official Rules. Running tallies, leaderboards, and any trophy or checkmark shown in the APP are informational and are not notice of winning. Only an official notice sent under the Official Rules tells you that you are a potential winner.

4. No Wagering

4.1 The Services are a free-to-enter promotional experience. They are not a sportsbook, casino, lottery, or paid fantasy or daily fantasy sports product. You cannot place a wager, pay an entry fee, or stake money on any outcome through the Services, and nothing on the Services is betting or gambling advice. Predictions made in the Services are for entertainment and the Promotion only. You may not use the Services to run a pool, side bet, or any arrangement in which participants pay money or anything of value to take part or to win.

4.2 Brand Partner advertising may include lawful sports wagering, fantasy sports, or similar products, shown only as described in Section 7. That advertising is separate from the Promotion. No Brand Partner account, deposit, wager, or purchase is part of, required for, or connected to entry, scoring, ranking, or any prize.

5. Intellectual Property

5.1 Ours. The Services, including their design, software, text, graphics, logos, and the ECFFB name and marks, are owned by ECFFB or its licensors and protected by law. Brand Partner names, logos, and advertising belong to the Brand Partner. We give you a limited, personal, non-exclusive, non-transferable, revocable right to use the Services for their intended purpose. We keep all other rights.

5.2 What you give us. You keep ownership of anything you submit, such as a username. You give us a non-exclusive, worldwide, royalty-free license to host, display, and use it as needed to operate the Services, including showing it on leaderboards and in the APP’s display of Mini-Challenge winners. This license does not let a Brand Partner use your username, name, or likeness. Publicity use of a winner’s name or likeness is governed by the Official Rules.

5.3 Feedback. If you send us suggestions, we may use them without owing you anything.

6. Third-Party Names, Data, and Links

6.1 No affiliation. ESPN, DraftKings, NCAA.com, Yahoo Sports, the College Football Playoff, the NCAA, colleges and universities, military branches, and agencies mentioned in the Services are the property of their respective owners. They are named only to identify what users are voting on or selecting. College and university names appear in plain text only, without logos or other marks. Unless a company is identified in the Services as a Brand Partner, ECFFB is not affiliated with, sponsored by, or endorsed by it. None of these organizations, and no Brand Partner, sponsors or is responsible for the Promotion.

6.2 Game data. Game schedules and results come from third-party data providers and the College Football Playoff. We do our best to use accurate data, but we do not guarantee it is error-free or timely. Scoring follows the Official Rules.

6.3 Links. The Services may link to websites or services we do not control, including Brand Partner sites. We are not responsible for them, and your use of them is at your own risk and subject to their own terms and privacy policies.

7. Brand Partners, Sponsored Content, and Advertising

7.1 Brand Partners on the Services. Third-party sponsors, advertisers, and advertising partners (“Brand Partners”) may appear on the Website and APP through advertisements, sponsored content, offers, and features described as “sponsored by,” “presented by,” or “in partnership with” a Brand Partner. Seeing Brand Partner content is part of the free Services and does not require your consent to receive marketing. A Brand Partner is not the sponsor of the Promotion and does not run it, choose winners, or fund any prize.

7.2 Labeling. We label Brand Partner advertising and sponsored content as advertising, using a label such as “Sponsored,” “Ad,” or “Presented by.” Brand Partner content is not part of the leaderboards, tallies, or official notices, and it cannot change the Official Rules.

7.3 Optional opt-in to Brand Partner marketing. You may choose to receive marketing and advertising from Brand Partners on a separate consent screen in the APP or on the Website. The boxes on that screen are not pre-checked. You may agree to (i) receive Brand Partner offers that we send for a Brand Partner, and (ii) separately for each Brand Partner named on the screen, let us share your contact information with that Brand Partner so it can contact you directly. Text messages from or for a Brand Partner require your separate express written consent naming that Brand Partner. These choices are optional and have no effect on your account, your entries, scoring, ranking, Mini-Challenge tallies, odds of winning, or any prize. You can withdraw at any time as described in our Privacy Policy.

7.4 Age-restricted content. Advertising, offers, and marketing for sports wagering, gambling, casino or casino-style games, alcohol, tobacco or vaping products, cannabis, or any other product that may lawfully be offered only to adults over 18 are shown or sent only to users whose account information shows they are at least 21 years old (or any higher age that applies), and only where the product may lawfully be advertised to that user. Keep your date of birth and state of residence accurate so these limits work.

7.5 Your dealings with Brand Partners. Any purchase, account, wager, or other transaction with a Brand Partner is solely between you and that Brand Partner and is governed by its terms and privacy policy. We do not endorse or guarantee any Brand Partner’s products, services, offers, or statements, and we are not responsible for them. If a Brand Partner offer involves gambling, follow the law where you are and the Brand Partner’s responsible gaming tools.

8. Paid Features

8.1 The Services are currently free. We may offer paid subscriptions or premium content in the future. Those offers will have their own terms, price, billing, and cancellation details shown before you buy. No purchase is ever required to create an account, enter the Promotion, or win a prize, and a purchase from ECFFB or any Brand Partner will not improve your chances.

9. Suspension and Termination

9.1 We may suspend or end your access, remove entries or votes, or disqualify you from the Promotion if we reasonably believe you broke these Terms or the Official Rules, or to protect the Services or other users. You may stop using the Services and close your account at any time by contacting us. Closing your account does not cancel prizes properly due under the Official Rules, and we may keep information as described in our Privacy Policy.

9.2 Sections that by their nature should continue after termination will continue, including those on intellectual property, Brand Partner dealings, disclaimers, liability, and governing law.

10. Disclaimers

10.1 The Services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the Services will be uninterrupted, error-free, or secure, or that scores, tallies, or leaderboards will always be current. We make no promise about any Brand Partner’s products, services, or offers. This does not limit any prize obligation under the Official Rules.

10.2 Some places do not allow certain disclaimers, so parts of this section may not apply to you.

11. Limitation of Liability

11.1 To the fullest extent permitted by law, ECFFB and its affiliates, service providers, and their officers, directors, employees, and agents are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of your use of the Services or your dealings with any Brand Partner.

11.2 This section does not apply to: our obligation to award a prize properly due under the Official Rules; our fraud, gross negligence, or willful misconduct; our own handling of your personal information in breach of our Privacy Policy; liability that cannot lawfully be limited; or your nonwaivable rights under the law where you live.

12. Indemnity

12.1 You agree to defend and reimburse ECFFB for third-party claims and reasonable resulting losses caused by your breach of these Terms or your violation of law or of another person’s rights through your use of the Services, to the extent permitted by law. This does not apply to claims caused by ECFFB’s own fraud, gross negligence, or willful misconduct.

13. Governing Law and Disputes

13.1 Law. Except where prohibited by law, these Terms and any dispute arising from the Services are governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-laws principles. Nothing here takes away a right or remedy you have under the law of your state that cannot be waived.

13.2 Courts. Except where prohibited by law, the state and federal courts located in Kentucky have jurisdiction over disputes under these Terms, and you and ECFFB consent to those courts.

13.3 No arbitration or class waiver. These Terms do not require arbitration and do not waive your right to a jury trial or to take part in a class or representative proceeding.

13.4 Try us first. Before filing a claim, we ask that you contact us at privacy@elitecollegefantasyfootball.com so we can try to resolve it informally. This is not a requirement that limits any right or deadline.

14. Changes to the Services and Terms

14.1 We may change or discontinue parts of the Services, including which Brand Partners appear. We may update these Terms by posting the new version with a new effective date. If a change is material, we will notify you by email or in the APP before it takes effect. A change will not alter the Official Rules for a Promotion already underway except as the Official Rules allow. If you keep using the Services after the effective date, you accept the updated Terms.

15. General

15.1 These Terms, the Official Rules, and the Privacy Policy are the entire agreement between you and ECFFB about the Services. If a part of these Terms is found unenforceable, the rest stays in effect. If we do not enforce a right, that is not a waiver. You may not assign these Terms without our written consent; we may assign them in a merger, sale, or similar transaction.
